In Colorado it is so long as one of the parties present is aware of it being recorded (thus the slang term "single-party state"). If your state IS a single -party state, record her behavior. Compile everything, then make several sets of copies of it. Keep the original and present a formal letter of protest to the state licensing authority with one set of copies. Make sure they know you have the originals, and don't tell them, even if they ask, where the other copies are.
