After my appointment with a lawyer to find out if it was possible to claim moneys lost due to my accident and any further loss of earnings. I found out all i have is a story to tell this pissed me off to no end, one day you go to work the next thing some prick stuffs up your life and he gets his wish. I did not seek a lawyer out to get rich out of this mans gutless act, just i didnt think it was fair that i should loose anything i will never again hold the job i had for 15yrs when i return to work. I have been told that by my employers and i can understand that given what i used to do. At the moment i receive workers comp and my meds are paid for very great full for that it took me 15yrs to work my way up the company ladder to where i was comfortable and earning a wage that would allow my wife to stay home. Since my accident my gross wages have dropped 20% my superannuation from my employee have stopped and the tax benefits have all been lost all this comes about by some other prick.:angry-fla So with much frustration i started ringing and emailing my local pollies with my story wanting a answer it all fell upon sympathetic ears saying that it was not fair but it was the law. So angrier i became only to find out if i had of twisted my back, hit my head, any physical injury at all i could claim for that and PTSD. The workers comp does not cover for psychological injures it will pay your meds and your med app bills but you are left with the financial burden. So after months of getting no where i decided to write a 13page letter to our Prime Minister thinking i would not receive a reply but it was getting it off my chest. Well it happened i received a reply letter from the P/Ministers office "shit" was all i could say for the day it said that it was not his department but my letter has been sent to the right minister ok ive got further than i thought i was happy to be heard and forgot about it. My next appointment with my psychologist he told me he had a phone call from the ministers office and thought it was me winding him up they worked out it was true and ask why he was being questioned. The reply he got was some thing close to this he had written it down because he couldnt believe himself. The ministers office wanted to know about my accident and what i had claimed in my letter was true. Being my psychologist i hadent kept any thing from him so he told them. End of their conversation was that i have been dealt with wrongly and a ministers side kick has been appointed to the job to answer my letter and complaints i know it wont get my any where but i tried and i have been heard. Good on you Nugget. I fought the battle and won with a six figure (out of court) settlement in the Northern Territory, without waivering my rights to proceed to court, should I so wish. No disrespect intended, as I am not fully versed in S.A work and health, but I would think there are avenues available to pursue damages. There was a review held here in NZ at the end of last year involving a PTSD case, and the specialist was a 'well known Australian psychiatrist' who was to give factual and supporting evidence that PTSD does in fact result in a 'physical brain injury'. I would appreciate further comments on this from anyone who has relevant information pertaining to or against this thesis.

Well, I have brain damage from PTSD. Not sure if it counts as physical or chemical, but it shows up on brain tests. I had an MRI recently and it shows that my right hippocampal volume is reduced by 18%. There have been a few studies conducted in this regard, with combat veterans and survivors of sexual abuse. I'm not a combat veteran or an abuse survivor, however.
There's a thread on the forum here about child sexual abuse and reduced hippocampal volume relating to PTSD, that you might be interested in :

Hey Zilly as far as i can find out through lawyers and ive tried a few and government departments they admit its wrong but a straight psychological disorder theres jack shit i can do if i had of physical injury then i would have a claim i could claim the physical and the PTSD unless their is a lawyer out there willing to help me tackle the system.

PTSD is a recognised disability... the only mental disorder I believe equivalent to losing a limb, even by the Governments standards as PTSD is now a recognised disability in Australia, and some other countries. The Government even prove this with military compensation through DVA, again; the only illness apart from losing a limb itself that will get you a TPI pension. That is an idea of how debilitating PTSD is, and is recognised even by the Government itself... maybe something to help you think more!!!

Thanks Anthony ive trod on some toes at the moment. I have contacted four lawyer firms, the SA Ombusman both liberal and labour government dept,WorkCover SA they all come up with the same answer under section blah blah their is no provisions to claim as my case is put under Stress. I shall keep pushing my point as far as im concerned its not how you got it, its the fact you have it. I dont want to take anything away from anybody else on the forum as to how they ended up with PTSD. I have Four medical reports stating that i have PTSD. I am not on a get rich quick ive got PTSD thing, i would rather have my old life back post my accident. Thanks mate

You took notice of that movie also... one of my all time favourites mate, along with Crackerjack! I understand you purpose of what your doing, the facts are mate, you can't go back now, and that was not a choice you had for the circumstances. I can say that I have nobody to blame except myself for my PTSD, as I signed on the dotted line to go into operational zones the moment I joined the military, but not all people own their PTSD, but it was inflicted upon them, as yours, rape, etc.

It just pisses me of to no end i started work that morning as normal as i was three hours later my lifes a mess and i told sorry its classed as stress what the? They (Workcover) agree that i have PTSD ive got so much paper work stating so ive been told my meds and shrinks app will be paid for untill i stop them. I dont wnat to get rich off this pricks act but i do not see why i should be on the wrong end of the ladder. JUST VENTING AGAIN
