Default New Here! PTSD From Automobile Accident

Hi everyone! Last April I was involved in a car accident. I bus ran a red light and t-boned my small sports car. My car was totaled and I then had to go to physical therapy for about 8 months. My doctor diagnosed me with PTSD, I have been seeing a PTSD therapist weekly. I feel like I've turned into a person I don't even know. It's so hard for me to do anything, even getting to work is a struggle. I have severe anxiety and problems sleeping. My doctor prescribed me lexapro and that seems to be helping a bit. I am currently involved with a lawsuit with the bus company. The lawyer I have is telling me its very difficult to get any sort of settlement from PTSD symptoms. Has anyone had to deal with this? It's seems very unfair to have to go through this and not get any sort of settlement??

Hi Ashmack, welcome to the forum. I could only recommend you seek help through resources within your country about legal matters, as legal advice could not be given here. I do not know what issues it has in legal contexts..... you would need to get expert legal advice about that.

Hello Ashmack, I have been through it and it is unfair. You will have to fight for it and my advice would be to always keep in mind what kind of settlement you might win and what the cost (personally and emotionally) will be. Take the legal advice from those in the know in your country.

From my experience I decided to take the best offer I could get out of the insurance company so I didn't prolong things any further and didn't have to go to court. I was advised by my solicitor that if I had gone to court I would not have got much more if any and of course I could have lost altogether (although that was highly unlikely as blame was not contested). No, it's not fair. I learnt a lot about the way the legal system views PTSD and how insurance companies work.

This is why my parents have been talking me down from a lawsuit. They say that I most likely will not win, and that I'll spend a lot of money trying. The more convincing argument was that I'd be emotionally attacked in court, reliving the experience and receiving a barrage of secondary wounds. They want me to get over it and move on with my life.

Knowing that someone got away with it is quite upsetting, the only reason I want to sue. And yes, it is incredibly unfair.
